In U.S. v. Heppner, 25 Cr. 503 (S.D.N.Y. Feb. 17, 2026), Judge Rakoff held that AI-assisted trial strategy shared with a third-party cloud platform lacked the confidentiality required for privilege protection. The court identified a clear gap: when your work product touches a vendor's servers, you've shared it with someone outside the privilege.

The Heppner ruling specifically addressed attorney-client privilege and the confidentiality prong — i.e., whether information was shared with a third party in a way that destroyed the privilege. Voir dire notes and strike strategy are more typically protected as attorney work product under Fed. R. Civ. P. 26(b)(3).
